Remote and electronic posting: Workplace Public Health Rights Poster: if physical posting is impractical (including remote work, private residences employing only one worker, and certain entirely outdoor work sites), the employer must give each worker a copy within the first month of work, which may be by electronic communication or conspicuous posting on a web-based platform if information is customarily shared that way. Agricultural employers must also post the Agricultural Labor Rights poster electronically (e-mail, intranet or internet site) if they customarily communicate with workers by those means.
Federal posters
- Employee Rights Under the Fair Labor Standards Act (minimum wage): Every employer covered by the FLSA
- Job Safety and Health: It's the Law (OSHA): Private-sector employers
- Know Your Rights: Workplace Discrimination is Illegal (EEOC): Employers with 15 or more employees
- Employee Rights Under the Family and Medical Leave Act: Employers with 50 or more employees
- Employee Polygraph Protection Act: Most private employers
- Your Rights Under USERRA: All employers (may be provided instead of posted)
Federal list: US DOL workplace posters and the DOL FirstStep Poster Advisor.
Details and exceptions
- The CDLE page says employers may be required by law to post certain posters and that the list may not be complete. It refers to the U.S. Department of Labor for federal posters.
- Employers with employees of limited English ability must use the Spanish COMPS poster for Spanish speakers or ask the Division for another language (COMPS Rule 7.4.3).
- Highly seasonal agricultural employers must give overtime and peak-week disclosures; the Division's courtesy form is optional.
- Each employer is responsible for producing and printing necessary notices (per the CDLE page).
