Remote and electronic posting: The reemployment assistance notice must also be given to each worker individually at separation; DLR says employers may use letters, emails, text messages or flyers, and offers an email/text version.

- Know Your Rights: Workplace Discrimination is Illegal (EEOC): Employers with 15 or more employees
- Employee Rights Under the Family and Medical Leave Act: Employers with 50 or more employees
- Employee Polygraph Protection Act: Most private employers
- Your Rights Under USERRA: All employers (may be provided instead of posted)

Details and exceptions
- South Dakota law requires only two state postings: the reemployment assistance notice and a safety-on-the-job posting.
