Tipped employees
Employers in New York can pay tipped employees a cash wage of $10.70 an hour, taking a tip credit of up to $5.30, as long as tips bring the employee to at least $16.00 for every hour worked. If they don't, the employer makes up the difference.

Rates can rise each year with inflation, but statutory off-ramps can block an increase; an off-ramp was met for 2027, so there is no increase on January 1, 2027.
Exceptions and details
- The state record shows the rest-of-state rate; NYC, Long Island and Westchester are $17.00.
- Tipped cash wage shown is for food service workers outside NYC/LI/Westchester ($10.70); tipped service employees there get $13.30. Only hospitality employers may take a tip credit.
- Home care aides rise on Jan. 1, 2027 to $20.00 (NYC, LI, Westchester) and $19.00 (rest of state).
- Governor Hochul has proposed changing the off-ramp provisions (not law).
